Soniferous Mobile Application

1. Introduction

Welcome to Soniferous.

These Terms & Conditions ("Terms") govern your access to and use of the Soniferous mobile application ("Soniferous", "the App", or "the Service").

Soniferous is a mobile application providing access to a curated collection of field recordings, nature sounds, and immersive natural soundscapes.

Soniferous is owned and operated by A State Of Flo ("we", "us", or "our").

By downloading, accessing, purchasing a subscription to, or using Soniferous, you agree to these Terms.

If you do not agree to these Terms, you must not use the App.

2. About Soniferous

Soniferous provides access to a library of audio recordings featuring natural environments, wildlife, landscapes, and other field-recorded sounds.

The App allows users to stream and download audio recordings for personal listening.

Certain content and features require an active paid subscription.

We reserve the right to modify, add, remove, or discontinue content or features, subject to applicable law and consumer rights.

3. Eligibility

You must be legally capable of entering into a binding agreement to use Soniferous.

If you are under the age of legal majority in your jurisdiction, you may only use the App with the permission and supervision of a parent or legal guardian, where required by law.

By using Soniferous, you confirm that you meet the applicable eligibility requirements.

4. Subscriptions and Payments

4.1 Annual Subscription

Soniferous offers an annual subscription at a price of £30 per year.

The subscription provides access to the available subscription content, including our collection of field recordings and nature soundscapes.

The applicable price, subscription duration, and renewal details will be displayed in the App before purchase. Prices may vary by country or currency, and the price displayed in your local app marketplace at the time of purchase will apply.

4.2 Payment Processing

Subscriptions are purchased through:

• Apple App Store for iOS users.

• Google Play Store for Android users.

Payments are processed by Apple or Google using the payment method associated with your platform account.

We do not directly collect or store your full payment card details.

RevenueCat is used to support subscription management and entitlement verification.

4.3 Automatic Renewal

Your annual subscription automatically renews for another year unless you cancel before the end of the current subscription period.

The applicable renewal price will be displayed by Apple or Google.

By purchasing an automatically renewing subscription, you authorise the relevant platform to charge your account for subsequent subscription periods, in accordance with its applicable terms.

4.4 Cancellation

You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings.

Cancellation generally takes effect at the end of the current paid subscription period.

Cancelling your subscription prevents future renewal but does not ordinarily provide a refund for the unused portion of the current subscription period.

This does not affect any statutory cancellation or refund rights you may have.

Uninstalling Soniferous does not automatically cancel an active subscription.

4.5 Refunds

Refund requests are generally handled by Apple or Google, depending on where your subscription was purchased.

We do not directly process subscription payments. However, this does not affect any refund rights you may have under applicable consumer protection legislation.

Refund eligibility is determined in accordance with the relevant platform's policies and applicable law.

4.6 Changes to Subscription Pricing

We reserve the right to change subscription prices in the future.

Any changes to subscription pricing will be communicated and implemented in accordance with applicable laws and the policies of Apple and Google.

Where required, you will receive advance notice of price changes.

5. Consumer Cancellation Rights

If you are a consumer in the United Kingdom, you may have a statutory 14-day cancellation period when purchasing digital content or services online.

For digital content supplied immediately after purchase, you may be asked to give express consent to immediate supply and acknowledge that your statutory cancellation right may be lost once supply begins, where the law permits this.

Any such consent and acknowledgement must be obtained through the applicable purchase process.

Nothing in these Terms removes or restricts your statutory consumer rights.

Where applicable, cancellation and refund requests should be submitted through the platform used to purchase your subscription.

6. Use of Audio Content

Soniferous provides audio recordings and nature soundscapes for personal listening.

You may:

• Stream recordings through the App.

• Download recordings for offline listening where the feature is available.

• Listen to recordings for personal, non-commercial purposes.

You may not:

• Redistribute, reproduce, or republish recordings without our prior written permission.

• Sell, sublicense, or commercially exploit recordings.

• Upload recordings to other platforms or services for redistribution.

• Use recordings as part of commercial projects without our prior written permission.

• Remove or alter copyright notices or ownership information.

• Extract or systematically download the App's audio library except where expressly permitted by law or by us.

Downloaded recordings are intended for use within Soniferous and may be subject to technical restrictions.

7. Intellectual Property and Audio Ownership

All audio recordings and soundscapes available through Soniferous are owned by A State Of Flo.

This includes the underlying field recordings, audio files, edits, soundscapes, arrangements, and associated audio content.

All intellectual property rights in Soniferous, including its audio library, branding, design, graphics, software, and associated materials, are owned by or licensed to A State Of Flo.

Your subscription or use of the App does not transfer ownership of any intellectual property rights to you.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use Soniferous and listen to its audio content for personal, non-commercial purposes in accordance with these Terms and the End User Licence Agreement.

All rights not expressly granted are reserved.

8. Prohibited Activities

You agree not to:

• Use Soniferous for unlawful purposes.

• Attempt to gain unauthorised access to the App or its infrastructure.

• Interfere with the operation or security of the Service.

• Circumvent subscription restrictions or access controls.

• Copy, extract, or redistribute protected audio content.

• Use automated systems to scrape or download content without permission.

• Reverse engineer or modify the App except where permitted by applicable law.

• Infringe the intellectual property or other rights of third parties.

We reserve the right to restrict or terminate access where we reasonably believe that a user has materially violated these Terms.

9. Availability of the Service

We aim to provide Soniferous as a reliable service.

However, we do not guarantee that the App will always be available, uninterrupted, error-free, or compatible with every device.

Access may be affected by:

• Internet connectivity.

• Device compatibility.

• Maintenance or updates.

• Third-party infrastructure.

• Technical failures.

• Circumstances beyond our reasonable control.

We reserve the right to modify, suspend, or discontinue all or part of the Service, subject to applicable law and consumer rights.

10. Audio Downloads and Offline Access

Soniferous allows users to download certain recordings to their devices for offline listening.

Downloaded content is stored locally on your device.

Offline availability may depend on:

• Available device storage.

• App functionality.

• Subscription status.

• Content availability.

• Technical restrictions.

We do not guarantee that all recordings will remain available for download or offline playback indefinitely.

11. Third-Party Services

Soniferous relies on third-party services, including:

• Apple App Store.

• Google Play Store.

• RevenueCat.

• Amazon Web Services (AWS).

These services may be subject to their own terms, conditions, and policies.

Your use of third-party platforms is subject to the terms applicable to those platforms.

12. Privacy

Your use of Soniferous is also governed by our Privacy Policy.

13. Disclaimer

Soniferous is provided on an "as available" basis.

To the extent permitted by applicable law, we do not guarantee that:

• The App will be uninterrupted or error-free.

• All recordings will remain permanently available.

• The App will be compatible with every device.

• The Service will meet every user's individual expectations.

Nothing in these Terms excludes any rights or protections that cannot be excluded under applicable law.

14. Limitation of Liability

To the maximum extent permitted by applicable law, A State Of Flo shall not be liable for indirect, incidental, special, or consequential losses arising from your use of Soniferous.

We shall not be responsible for losses arising from:

• Temporary unavailability of the App.

• Loss of downloaded content resulting from device issues.

• Third-party service interruptions.

• Unauthorised use of your device or platform account.

• Your failure to comply with these Terms.

Nothing in these Terms excludes or limits liability for:

• Death or personal injury caused by negligence.

• Fraud or fraudulent misrepresentation.

• Any liability that cannot lawfully be excluded or limited.

• Your statutory consumer rights.

Where you use Soniferous as a consumer, nothing in these Terms affects your rights under applicable consumer protection legislation.

15. Termination

We may suspend or terminate your access to Soniferous where:

• You materially breach these Terms.

• Your use of the App is unlawful.

• You attempt to compromise the security or integrity of the Service.

• We are required to do so by law.

You may stop using Soniferous at any time by uninstalling the App.

Uninstalling the App does not automatically cancel an active subscription. You must cancel your subscription separately through your Apple or Google account settings.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes to the App, our services, or applicable legal requirements.

Updated Terms will be published on our website or made available through the App.

The "Last Updated" date will be revised accordingly.

Where required by law, we will provide notice of material changes.

17. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes arising from these Terms or your use of Soniferous shall be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory consumer protection rights that apply in your country of residence.
